Terms of Service
Use There You Were only to reconnect after a genuine encounter in a public place. Respect privacy, accept “no,” and never use the service to identify, locate, follow, pressure, or intimidate another person.
1. Agreement and eligibility
These Terms are an agreement between you and Dreaming Above Labs governing There You Were. You must be at least 18 years old and located in the United States to use the service. If you do not agree to these Terms, the Privacy Policy, and Community Guidelines, do not create an account or submit content.
2. Anonymous, device-bound accounts
The service uses anonymous accounts without email, phone, password, or social sign-in. Your session is stored on your device. Signing out, deleting the app, losing the session, or changing devices may permanently remove your access, and we may be unable to recover the account. You are responsible for activity performed through your session.
3. Appropriate use
You may use the service only for lawful, personal, non-commercial efforts to reconnect after a genuine public encounter. You agree that you will not:
- Post exact home addresses, phone numbers, email addresses, social handles, license plates, schedules, or other private identifying information.
- Impersonate another person or falsely claim that a post describes you.
- Harass, threaten, stalk, shame, sexualize, discriminate against, track, or intimidate anyone.
- Post sexual or exploitative content, scams, spam, illegal content, or content involving a minor.
- Scrape, copy, index, sell, or build a database from posts or user activity.
- Bypass rate limits, CAPTCHA, access controls, moderation, or other security measures.
- Reverse engineer, disrupt, overload, or gain unauthorized access to the service.
4. Posts and communications
You retain ownership of content you submit. You grant Dreaming Above Labs a limited, worldwide, nonexclusive, royalty-free license to host, process, reproduce, display, and transmit that content only as needed to operate, secure, moderate, and improve the service. Public posts can be viewed by others. Initial responses and accepted conversations are private to the participants, subject to safety, support, enforcement, and legal access described in the Privacy Policy.
5. Safety
There You Were does not verify identities, encounters, intentions, or claims. A post is not proof that someone is the described person. Do not meet anyone if you feel unsafe, and use ordinary precautions for any interaction. The service is not an emergency service. Call 911 if you or someone else is in immediate danger.
6. Moderation
We may investigate reports; limit visibility; remove content; close responses or conversations; restrict, suspend, or delete accounts; preserve relevant records; and cooperate with valid legal requests when reasonably necessary to enforce these Terms or protect people and the service. We are not obligated to host any content, and moderation decisions may be made without advance notice in urgent or serious cases.
7. Blocking and reporting
Use the in-app tools to block an account or report content. Do not make knowingly false reports or use reporting to harass another person. Blocking is intended to stop further interaction, but no technical control can guarantee that a person will not create another account or encounter you elsewhere.
8. Service changes and availability
We may change, suspend, or discontinue features or the service. Posts expire from public discovery after 30 days. We do not guarantee that a post will be seen, that a person will respond, that a connection will be genuine, or that notifications and location results will always be accurate or available.
9. Third-party services
The service relies on Apple, Supabase, and Firebase components subject to their respective terms. We are not responsible for third-party services outside our control.
10. Intellectual property
The app, brand, design, software, and non-user content are owned by Dreaming Above Labs or its licensors and protected by applicable law. These Terms grant you a limited, revocable, nontransferable right to use the app for its intended purpose.
11. Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, availability, accuracy, safety, or results. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Dreaming Above Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss arising from user conduct, missed or false connections, meetings, content, data loss, unauthorized access, or service interruption. Rights that cannot legally be limited remain unaffected.
13. Indemnity
To the extent permitted by law, you agree to defend and hold Dreaming Above Labs harmless from claims, losses, and reasonable costs arising from your content, misuse of the service, violation of these Terms, or infringement of another person’s rights.
14. Termination and deletion
You may stop using the service or delete your account in Profile. We may restrict or terminate access for violations, risk, legal requirements, or discontinuation. Terms that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will survive.
15. Governing law
These Terms are governed by the laws of the State of Kansas and applicable United States federal law, without regard to conflict-of-law principles. Nothing in these Terms removes consumer rights that cannot be waived under applicable law.
